DMCA & Copyright Policy

Pet a Day respects the intellectual property rights of others and expects our users to do the same. We respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Pet a Day hosts several kinds of content: AI-generated stock imagery and video in our Stock Marketplace, user-generated creator content (photos, videos, and posts uploaded by creators), and business directory listings. This policy applies to all of it. If you believe material on Pet a Day infringes a copyright you own or control, you may submit a takedown notice as described below.

1. Filing a DMCA takedown notice

To be effective under 17 U.S.C. § 512(c)(3), your written notice to our designated agent must include all of the following:

Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).
Identification of the infringing material and information reasonably sufficient to let us locate it — including the specific URL(s) on petaday.com where it appears.
Your contact information — your full legal name, mailing address, telephone number, and email address.
A good-faith statement that you believe the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
Your physical or electronic signature.

Incomplete notices may not be actionable. Note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.

2. Designated DMCA agent

Send your takedown notice to our designated agent for receiving notifications of claimed infringement:

Please use the subject line "DMCA Takedown Notice" so we can route your request promptly.

3. What happens after a valid notice

When we receive a complete and valid notice, we will remove or disable access to the allegedly infringing material and make a reasonable effort to notify the user who posted it. The user may submit a counter-notification if they believe the material was removed in error.

4. Counter-notification

If your content was removed and you believe the removal was the result of a mistake or misidentification, you may send a written counter-notification to our designated agent. Under 17 U.S.C. § 512(g)(3), it must include:

Identification of the material that was removed and the location where it appeared before removal.
A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Pet a Day may be found), and that you will accept service of process from the person who filed the original notice or their agent.
Your physical or electronic signature.

If you submit a valid counter-notification, we may restore the material in ten to fourteen business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. Repeat-infringer policy

In accordance with the DMCA and other applicable law, Pet a Day will, in appropriate circumstances, disable and/or terminate the accounts of users who are determined to be repeat infringers. We may also limit access to the platform or remove content for any user who repeatedly posts infringing material, with or without prior notice.
